Qantas Postcards Terms and Conditions
Please read these Terms and Conditions carefully as they govern the use of the Qantas Postcards service, which is operated by ScribblePics Pty Ltd (ABN 56 129 700 009).
Content
You are responsible for all images and text that you upload using the Qantas Postcards service. This means that if you upload content using the Qantas Postcard service that is illegal or otherwise gives rise to liability, such as images or text that infringes copyright, is defamatory, pornographic or otherwise inappropriate, this it is your responsibility.
You also understand that such conduct by you entitles ScribblePics to disclose your personal information in accordance with the Privacy Act 1988 (Cth).
ScribblePics reserves the right to screen content that you upload onto to the Qantas Postcards service to ensure compliance with these Terms and Conditions or applicable laws, but is not obliged to do so.
You agree to indemnify Qantas and ScribblePics from any claim arising from content that you upload to the Qantas Postcards service.
Prohibited Content
Where we detect inappropriate or prohibited content, your postcard will be destroyed and will not be delivered, and the cost of the relevant postcards will not, to the extent permitted by law, be refunded.
Copyright
Copyright in the images used on the postcard remains the property of the respective copyright owner.
Payment
Each postcard costs AUD3.30, which can be paid using either Visa or MasterCard .
Your Obligations
You agree not to interfere with or disrupt the Qantas Postcards service, not to reverse engineer or otherwise decompile Qantas or ScribblePics' source or object code other than as permitted by law.
Privacy
By completing your details on the payment form, you consent to ScribblePics and Qantas (including its related entities, agents and contractors acting on its behalf) using that information:
to fulfil your order;
to offer and provide to you benefits available from time to time; and
for research and marketing of Qantas, Oneworld and partner products and services.
Without limiting the foregoing, your personal information provided in connection with the Qantas Postcards service will be handled in accordance with Scibblepics' Privacy Statement and Qantas's Privacy Statement.
Limit of Liability
To the extent permitted by law, Qantas and ScribblePics exclude all liability for any loss or damage whatsoever (including but not limited to physical and psychological injury, and loss or damage to property of whatever nature) that may arise in any way in connection with the offer or supply of goods or services through Qantas, ScribblePics or any third parties, or in connection with the supply of such goods or services.
Entire Agreement, No Waiver and Serverability
These terms constitute the entire agreement between you and ScribblePics concerning your use of the Qantas Postcards service. You acknowledge that if ScribblePics does not exercise any legal right or remedy, whether contained in these Terms and Conditions or under an applicable law, that does not constitute a waiver of that right or remedy. If any of the provisions in these Terms and Conditions are ruled to be invalid by a court of competent jurisdiction that provision is, to the extent possible, removed without affecting the other provisions. The remaining terms will continue to be valid.
Governing Law
These Terms and Conditions are governed by the laws of Australia and any action arising under them or in any way connected with the Qantas Postcards service may be brought only in a court in Australia, subject to any law which is expressly inconsistent with this.
